General Terms and Conditions of the Driving Theory Portal


1. Introductory Provisions

1.1. These General Terms and Conditions (hereinafter "GTC") regulate the mutual rights and obligations between: Operator: Jaroslav Šuška, registered office Hynkovská 226/16, Skrbeň, 783 34, ID No.: 76306445 (hereinafter "Provider") and User: Natural or legal person using the portal services (hereinafter "User").

1.2. Service: Web portal "Driving Theory" (hereinafter "Service") located at delamridicak.cz and related applications, serving for practicing tests for driving school students.

1.3. Contract: The contractual relationship between the Provider and the User arises either by completing the User's registration or by paying for the paid part of the Service (digital content).

2. Registration and User Account

2.1. Use of selected parts of the Service is allowed only after registration and creation of a user account. Registration is free.

2.2. The User is obliged to provide correct and true data during registration and to update them in case of any change.

2.3. Prohibition of sharing: The User account is personal and non-transferable. The User must not share their login credentials with third parties. In case of detection of suspicious activity (e.g., logging in from many different IP addresses simultaneously), the Provider reserves the right to temporarily or permanently block the account without compensation.

3. Payment Conditions and Digital Content

3.1. The Service offers paid digital content (e.g., detailed test evaluation, explanation of questions, extended statistics).

3.2. Price: Current prices of packages and subscriptions are listed in the price list on the Service website. All prices are listed including VAT (if the Provider is a VAT payer).

3.3. Payment methods: Payment can be made via payment gateway (payment card, Apple Pay, Google Pay).

3.4. Access to content: The paid Service is activated immediately after receiving confirmation of successful payment.

4. Withdrawal from Contract

4.1. The User, who is a consumer, acknowledges that according to § 1837 letter l) of the Civil Code, they cannot withdraw from the contract for the supply of digital content if it was supplied with their prior express consent before the expiration of the withdrawal period.

4.2. The User hereby explicitly agrees that the digital content be made available to them immediately after payment and acknowledges that by this consent, their right to withdraw from the contract without giving a reason within 14 days expires.

5. Rights from Defective Performance (Complaints)

5.1. The Provider is liable to the User that the digital content is free of defects upon availability and for the duration of the contract and corresponds to the description of the Service.

5.2. The User has the right to file a complaint in case of malfunction of the Service (e.g., long-term server outage, malfunction of the purchased package).

5.3. Complaints can be filed via e-mail at: info@drivingtheory.cz. The Provider will decide on the complaint and notify the User no later than 30 days from its receipt.

6. Personal Data Protection (GDPR)

6.1. The Provider processes personal data of the User (especially e-mail, name, payment data, and progress statistics) in accordance with Regulation (EU) 2016/679 (GDPR).

6.2. The legal reason for processing is the performance of the contract and legal obligations (accounting).

6.3. Detailed information on the processing of personal data, User rights, and the use of cookies are set out in a separate document Privacy Policy available on the Service website.

7. Disclaimer

7.1. Educational purpose: The Service serves exclusively as a study aid. The Provider does not guarantee the result of the User's real exam at the driving school nor their subsequent fitness to drive motor vehicles.

7.2. Content accuracy: The Provider makes every effort to ensure the topicality of test questions according to the bulletins of the Ministry of Transport of the Czech Republic. However, the Provider is not liable for damages caused by potential errors in data or delays in updates during sudden legislative changes.

8. Final Provisions

8.1. All legal relationships arising from these GTC are governed by the legal order of the Czech Republic.

8.2. Out-of-court dispute resolution: In the event of a consumer dispute that cannot be resolved by mutual agreement, the User (consumer) has the right to submit a proposal for out-of-court resolution of such a dispute to the Czech Trade Inspection Authority (Central Inspectorate – ADR Department, Štěpánská 15, 120 00 Prague 2, web: www.coi.cz).

8.3. The Provider is entitled to unilaterally change the wording of the GTC. The User will be informed of substantial changes by e-mail or notification within the Service.

8.4. These GTC come into effect on 1 January 2026.
